Payne, Jr., Gary Dawson, Jason Dawson, Heather Justis, Brenda Chandler, Linda Sharpe, Helen Ball Payne, Charlene Gilbert, Kaitlyn Payne, Caleb Payne (infant), Lewis Payne, Danny Lamb, Bryce Lamb, Wayne Lamb, Ann Hixson, Gail Landers, and Louise Payne Watson and all unknown heirs of James Carl Payne, Linda Kelley, Greeneville Builders Supply, Emergency Medical Service, Laughlin Memorial Hospital Inc., and all who would have an interest in real estate located at 514 N. Hill Street, Greeneville, TN and at 3196 Gap Mountain Road, Greeneville, TN, Defendants.                      

In obedience to Judgments/Orders of the Chancery Court at Greeneville, Tennessee, in the above-styled cases, I will on Saturday, the 30th day of December, 2017, regarding two (2) different locations and  beginning with SALE NO. 1 at 12:00 noon and beginning with SALE NO. 2 at 1:00 pm, ON THE respective PREMISES, SELL, without the right of redemption or equity of redemption and subject to the Judgments/Orders entered in the above captioned lawsuit, to the best and highest bidder, the real property described in the corresponding papers, filed in the above referenced cause, and specifically, pursuant to the DEFAULT JUDGMENT; JUDGMENT ON THE PLEADINGS AND ORDER OF SALE, entered July 17, 2017 and described as follows:

SALE NO. 1 @ 12:00 noon on the premises at 514 N. Hill Street; Greeneville, TN  37743

PARCEL #1: [Map 098D, Parcel 018] {Lot 20}

Situate in the 10th Civil District of Greene County, Tennessee, and in the Town of Greeneville, and more particularly described as follows:

Beginning on a point in Hill Street, corner to Lot No. 19 and Lot 20, and running with said street to the corner of Lot No. 21; thence with the line of Lot No. 21, 89 feet to a 12 foot alley; thence with said alley 50 feet to the line and corner of Lot No. 19; thence with the line of Lot No. 19, 138 feet to the beginning, and being all of Lot No. 20 to the North Irish Street Addition to the Town of Greeneville, Tennessee, a plat of which is found of record in the Register’s Office for Greene County, Tennessee in Deed Book 94, page 582.

BEING the same property conveyed to James C. Payne by Quitclaim Deed of Alice Fay Payne, dated June 27, 1986, and which is of record in Deed Book 398, page 51, in the Register’s Office for Greene County, Tennessee.  James C. Payne died intestate in Greene County, Tennessee, on October 19, 2011.  For further reference see a Default Judgment, Judgment on the Pleadings and Order of Sale in the partition suit styled Dale Patterson vs. Lela Mae Patterson Fox, et al., Civil Action No. 2016-CV-91, in the Chancery Court for Greene County, Tennessee, whereby Kay S. Armstrong was appointed as Special Commissioner.

PARCEL #2: [Map 098D, Parcel 019] {Lot 21}

Situate in the 10th Civil District of Greene County, Tennessee, and in the Town of Greeneville, and more particularly described as follows:

Being Lot No. 21 in the North Irish Addition to the Town of Greeneville, Tennessee, and is fully described in the map of said Addition which appears of record in Deed Book 94, page 582, Register’s Office for Greene County, Tennessee.

BEING the same property conveyed to James C. Payne by Warranty Deed of Harley White, dated September 4, 1981, and which is of record in Deed Book 366, page 361, in the Register’s Office for Greene County, Tennessee. James C. Payne died intestate in Greene County, Tennessee, on October 19, 2011.  For further reference see a Default Judgment, Judgment on the Pleadings and Order of Sale in the partition suit styled Dale Patterson vs. Lela Mae Patterson Fox, et al., Civil Action No. 2016-CV-91, in the Chancery Court for Greene County, Tennessee, whereby Kay S. Armstrong was appointed as Special Commissioner.

 

SALE NO. 2 @ 1:00 p.m. on the premises, 6.84 Acres +/-, at 3196 Gap Mountain Road, adjoining Baneberry Road and Kite Road in Greeneville, TN  37745 OFF HORTON HWY. [Map 025, Parcel 025]

Situate in the 11th Civil District of Greene County, Tennessee, and being more particularly described as follows:

Tract 1: A boundary of land described and bounded as follows:
Bounded on the North by the public road; on the east by the lands of Bob Fink; on the south by the lands of G.B. Carter heirs; on the west by the lands of G.B. Carter heirs, said tract containing, by estimation, eight acres.  A part of this land having been heired by the said J.W. Presley from his father, the late S.P. Presley and a part of it having been bought by J.W. Presley from Perry Presley and part from Mrs. Hariet Carter. 

This being a portion of the J.W. Presley Farm which was cut off from the J.W. Presley Farm by the recent construction of the public road mentioned as being the boundary on the North side of this land.

 

Tract 2: This being a small tract of land triangular in shape and bounded on the north side by the mountain road on the southeast by the Dunkard Church Road and on the third side by other lands of Bailey Presley.  This being all the land owned by Charlie Booker on the south side of the mountain road and contains approximately ½ acre by estimation.

Being the same property conveyed to Minnis Payne, a one-half (½) undivided interest for life, in which he and wife, Ella Price held title as tenants by the entirety, remainder interest unto James C. Payne in fee simple, by warranty deed of Ella Payne, dated September 15, 1989, recorded in Deed Book No. 421, page 413, Register’s office for Greene County, Tennessee. Minnis Payne and Ella Payne are deceased.  James C. Payne died intestate in Greene County, Tennessee, on October 19, 2011.  For further reference see a Default Judgment, Judgment on the Pleadings and Order of Sale in the partition suit styled Dale Patterson vs. Lela Mae Patterson Fox, et al., Civil Action No. 2016-CV-91, in the Chancery Court for Greene County, Tennessee, whereby Kay S. Armstrong was appointed as Special Commissioner.

The Clerk & Master has undertaken NO inspections, examination or clean-up of the real property.  (The property will be sold subject to all defects, including any structural defects and contamination, if any, which may exist.)
