In obedience to an order of the Chancery Court at Greeneville, Tennessee, in the above-styled case, I will on Saturday, the 4TH day of December, 2004, beginning at 10:01 a.m. on the premises, sell to the best and highest bidder, the real property in said Judgment/Order located at 940 Kite Road in Greeneville, Tennessee

              SITUATE in the 11th Civil District of Greene County, Tennessee, and described as follows:  BEGINNING at an iron pin in the easterly right of way line of Kite Road and corner to Bonnie Christiano;  thence with the line of Christiano, S. 82 deg. 39 min. 00 sec. E., 686.28 ft. to an iron pin;  thence with the line of Christiano and Ruth Kilday Heirs Farm S. 2 deg. 31 min. 00 sec. E., 346.21 ft. to a fence post;  thence S. 89 deg. 30 min. 00 sec. W., 429.00 ft. to an iron pin corner to a 1.50 acre tract;  thence with said tract N. 0 deg. 30 min. 00 sec. W., 190.50 ft. to an iron pin;  thence N. 82 deg. 39 min. 00 sec. W., 298.41 ft. to an iron pin in the right of way line of Kite Road;  thence with said road, N. 8 deg. 23 min. 0 sec. E., 211.0 ft. to the point of BEGINNING, containing 5.00 acres, more or less, with a double-wide MOBILE HOME situated thereon.

 BEING the same property conveyed to Harold D. Kirkpatrick and wife, Katherine L. Kirkpatrick, by warranty deed from Bonnie Bell Paul Christiano, dated May 28, 1997, and recorded in Deed Book 66A, page 69, in the Register’s Office for Greene County, Tennessee.

            Property description(s) is/are taken from the previous deed(s) of record, without the benefit of a recent survey. _______________________________________________________________________

TERMS OF SALE OF REALTY & MOBILE HOME

Sale will be made 10% down day of sale with the remainder paid on or before thirty (30) days from the date of sale.  PROPERTY WILL BE SOLD “AS IS” WITH NO WARRANTIES AND WITH NO REPRESENTATION BEING MADE AS TO THE STATE OF THE TITLE OR THE ACCURACY OF THE LEGAL DESCRIPTION.

Further, in obedience to an order of the Chancery Court at Greeneville, Tennessee, in the above-styled case, I will on Saturday, the 4TH day of December, 2004, immediately after the auction of the above described real property and, also, on the premises, sell to the best and highest bidder, the following listed personal property:

1996 Yamaha motorcycle X3A,

 1980 Harley-Davidson motorcycle, FLT and a four-wheeler.
