IN RE: ESTATE OF NORMA JEAN PATES THORNBURG

for the State of Tennessee, 
3RD JUDICIAL DISTRICT,
sitting in GREENE COUNTY
at GREENEVILLE [PROBATE DIVISION]

In obedience to Judgments/Orders of the Chancery Court at Greeneville, Tennessee, in the above-styled cause, I will on Thursday the 13th day of NOVEMBER, 2014, beginning at 5:00 p.m. and ON THE PREMISES, SELL, without the right of redemption or equity of redemption and subject to the Judgments/Orders entered in the above captioned cause, to the best and highest bidder, the real property described in the corresponding papers, filed in the above referenced cause, and located in the 8th Civil District of Greene County, Tennessee.
Pursuant to the orders of the Chancery Court for Greene County, at least and specifically the ORDER OF SALE entered September 11, 2014 in Probate Minute Book 183 at pages 253-255, Kay Solomon Armstrong is ordered to sell, as Special Commissioner/Master, the real property, described as follows:
PARCEL NO. 1: SITUATE in the 8th Civil District of Greene County, Tennessee, and being more particularly described as follows:
TRACT NO. 1: BEGINNING on an iron pin in the center of a public road corner to Jean Pates Thornburg; and running thence with the center of said road South 76 deg. 38 min. East 36.0 feet to an iron pin; thence South 53 deg. 19 min. West 251.1 feet to an iron pin; thence North 46 deg. 25 min. East 229.65 feet to the BEGINNING, containing 0.08 acres, more or less, as surveyed by D. C. Bowman, Surveyor, June 17, 1975.
TRACT NO. 2: BEGINNING on an iron pin in the center of a public road and corner to Jean Pates Thornburg; and running thence with Thornburg, South 37 deg. 30 min. West 174.95 feet to an iron pin; thence North 52 deg. 26 min. West 22.0 feet to an iron pin; thence North 37 deg. 12 min. East 172.9 feet to an iron pin in the center of a public road; thence with the center of said road, South 57 deg. 44 min. East 23.0 feet to the BEGINNING, containing 0.09 acres, more or less, as surveyed by D. C. Bowman, Surveyor, June 17, 1975.
BEING a part of the same property conveyed to Carl Graham by deed of Georgia Graham Britton, et al, dated August 30, 1937, and found of record in Deed Book 137, page 568, in the Register's Office for Greene County, Tennessee. The said Carl Graham is deceased, having died testate in Greene County, Tennessee, on June 2, 1975, and he devised the property to Jimmie Graham Pates, Suzy Loretta Pates Cox, Mary Foy Pates Barham and Norma Jean Pates Thornburg by Will of record in Will Book 14, page 291, in the Probate Clerk's Office for Greene County, Tennessee. to Norma Jean Pates Thornburg, dated July 2, 1975, and found of record in Deed Book 329, page 41, in the Register's Office for Greene County, Tennessee. Norma Jean Pates Thornburg died testate in Greene County, Tennessee, on September 7, 2012, and pursuant to the terms of her Last Will and Testament she devised her real property to Brian Pates Barham. For further reference see an Order of Sale, entered September 11, 2014, in the Probate File No. 14P00052, in the Clerk & Master's Office for Greene County, Tennessee, whereby Kay S. Armstrong, as Special Commissioner, was ordered to sell the real property of the decedent.
PARCEL NO. 2: Situate in the 8th Civil District of Greene County, Tennessee, and more particularly described as follows:
BEGINNING on a stake in the center of the public road a corner to the remaining lands of Carl Graham; thence with said Graham South 46 deg. 25 min. West (passing an iron pin at 19.2 feet) a total distance of 229.65 feet to an iron pin; thence with same North 52 deg. 26 min. West 117.7 feet to an iron pin; thence with same North 37 deg, 30 min. East (passing an iron pin at 138.2 feet) a total distance of 174.95 feet to a stake in the public road; thence with said road, South 65 deg. 14 min, East 78.0 feet; thence South 76 deg. 38 min. East 84.6 feet to the BEGINNING, containing .59 acres, more or less, as surveyed by D. C, Bowman, Surveyor, February 26, 1972.
SUBJECT TO a Right-of-Way Easement in favor of the Old Knoxville Highway Water Utility District, dated November 6, 2009, and found of record in Deed Book 489A, page 1879, in the Register's Office for Greene County, Tennessee.
BEING the same property conveyed to Jean Pates Thornburg by deed of Carl Graham, widower, dated March 1, 1972, and found of record in Deed Book 297, page 152, in the Register's Office for Greene County, Tenn essee. Norma Jean Pates Thornburg died testate in Greene County, Tennessee, on September 7, 2012, and pursuant to the terms of her Last Will and Testament she devised her real property to Brian Pates Barham. For further reference see an Order of Sale, entered September 11, 2014, in the Probate File No. 14P00052, in the Clerk & Master's Office for Greene County, Tennessee, whereby Kay S. Armstrong, as Special Commissioner, was ordered to sell the real property of the decedent.

Sale of real property will be made 10% down day of sale with the remainder paid on or before thirty (30) days from the date of sale. BID SHALL NOT BE LEFT OPEN.
ALL PROPERTY WILL BE SOLD "AS IS" WITH NO WARRANTIES, AND WITH NO REPRESENTATION BEING MADE AS TO THE STATE OF THE TITLE OR THE ACCURACY OF THE LEGAL DESCRIPTION OF THE REAL PROPERTY, AS WELL AS SOLD SUBJECT TO ANY LEASEHOLD INTEREST(S) AND/OR ANY OTHER AGREEMENT(S).
Said property will also be sold subject to all rights-of-way and easements, applicable building/zoning regulations, any restrictive covenants, as well as any defects including structural defects and/or contamination, if any, which may exist. The Clerk & Master/Special Commissioner has undertaken NO inspections, examination or cleanup of the subject property.
