In obedience
to Judgments/Orders of the Chancery Court at Greeneville,
Tennessee, in the above-styled cause, I will on Thursday
the 20th day of NOVEMBER, 2014, beginning at
5:00 p.m. and ON THE PREMISES, SELL,
without the right of redemption or
equity of redemption and subject to the Judgments/Orders entered
in the above captioned cause, to the best and highest bidder,
the real property described in the corresponding papers, filed
in the above referenced cause, and located in the 14th Civil
District of Greene County, Tennessee. Pursuant to the orders
of the Chancery Court for Greene County, at least and
specifically the ORDER OF SALE
entered September 17, 2014 in Probate Minute Book 183 at pages
300-301, Kay Solomon Armstrong is ordered to sell, as Special
Commissioner/Master, the real property, described as follows:
SITUATED in the 14th Civil District adjoining the lands of
Moreley, Fraker, Marshall and probably others and bounded as
follows, to wit:
First Tract:
Beginning at a stake in the Old Stage Road, corner to Moreley,
Myers and Argenbright, then a westerly direction with said road
to a branch near Will Rupe, then with the branch to Marshall's
line, then Southeast with Marshall's line to the brow of the
hill to the Joe Shields corner, then with Marshall's line to a
white oak, then S. 86 3/4 E. 49 4/5 poles to a small white oak,
then S. 18 1/2 E. 36 2/5 poles with Marshall's line to a stake,
Marshall's corner, then with Ripley's line N. 48 1/2 E. 24 poles
to a stake in a fence in Ripley's line, then N. 16 1/4 E. 34
poles to a stake and gum pointers, then N. 8 1/2 W. 36 poles to a
stake, then N. 34 1/4 W. 5 poles to a stake in Moreley's line,
then with his line S. 51 W. 34 1/5 poles to a white oak, then N.
36 W. 13 1/2 poles to a hickory stump, then with Moreley's line to
the Beginning, Containing 53 3/5 acres more or less. Also a
right-of-way 14 feet wide extending over the premises above
described to the public road as said right-of-way is now laid
out. For a more complete description of said right-of-way
reference is here made to the dead of R. H. M. Donnelly to C.
K. Hankel, of record in Deed Book 94 at page 257 in the
Registers office in Greeneville, Tennessee. However, there is
excepted from the above description, and not included in this
conveyance, tract of 6 acres, more or less, field to Boyd Rupe
by deed dated March 16, 1946 and registered in the Registers
office in Greeneville, Tennessee, in Deed Book 162 at page 318.
Second Tract:
Beginning at a fence post the northwest corner to the Hankel
land and running thence with same S. 30 W. 6.02 Chs. to a post
on Lewis line, then with his line N. 67-05 W. 13.50 (13-60
on slope) Chs. to a set stone a corner to two Lewis tracts, then
with Lewis N. 74-15 W. 7.43 (7.78 on slope) Chs to a set stone
on top of McCartheys Mountain on Cordie Greers line, then with
her line N. 24-50 E. 3.07 chs to a set stone, her corner, then
N. 35-15 E. 2.80 Chs. to a set stone on the top of said Mountain
on the Greer line, then with Testermen's line S. 70-15 E. 21.11
(21.48 on slope) Chs. to a point bearing N. 25 1/4 E. 12 feet
from the beginning corner, then continuing with said remaining
lands, parallel and 12 feet distance from the Hankel line S.
64-45 E. 5.35 Chs. to a point on the Pike road, corner to the
said remaining lands on a line of Hylton, then S. 33-45 W. 12.2
feet to Hankal's corner, then with His line N. 64-45 W. 5.32 Chs
to the beginning. Containing 12 acres more or less. BEING a
portion of the same property conveyed to B.L. McIntosh and wife,
Mae McIntosh, by deed of C.E. Dulaney and wife, Minnie Dulaney,
dated August 20, 1946, and appearing of record in Deed Book
164, page 509, in the Register's Office for Greene County,
Tennessee. B.L. (Brownlow) McIntosh predeceased his wife. Mae
Kathleen McIntosh died testate on August 5, 2005, and pursuant
to the terms of her Last Will and Testament which appears of
record in Will Book 58, page 220, in the Clerk & Master's Office
for Greene County, Tennessee, she devised the subject property
to the following: Eula McIntosh Stoner, Blanch McIntosh Slagle,
Robert McIntosh, Alton McIntosh, Lawrence McIntosh and Joan
McIntosh Lowe. For further reference see an Order of Sale
entered in the matter of the Estate of Mae Kathleen McIntosh,
Probate file No. 2005P191, in the Clerk & Master's Office for
Greene County, Tennessee, whereby Kay S. Armstrong was appointed
Special Commissioner to sell all real property of the
decedent. THERE IS EXCEPTED HEREFROM two (2) tracts conveyed
to Elzie C. Estepp and wife, Beula Estepp, by deed of B.L.
McIntosh and wife, Mae McIntosh, dated April 22, 1949, and
appearing of record in Deed Book 174, page 59, in the Register's
Office for Greene County, Tennessee. THERE IS FURTHER
EXCEPTED HEREFROM a 4.00 acre tract conveyed to Alton McIntosh
and wife, Janie McIntosh, by warranty deed of B.L. McIntosh and
wife, Mae McIntosh, dated November 17, 1970, and appearing of
record in Deed Book 284, page 276, in the Register's Office for
Greene County, Tennessee.

remainder paid on or before thirty (30) days from the date of

NO REPRESENTATION BEING MADE AS TO THE STATE OF THE TITLE OR THE
ACCURACY OF THE LEGAL DESCRIPTION OF THE REAL PROPERTY, AS WELL
AS SOLD SUBJECT TO ANY LEASEHOLD INTEREST(S) AND/OR ANY OTHER
AGREEMENT(S). Said
property will also be sold subject to all rights-of-way and
easements, applicable building/zoning regulations, any
restrictive covenants, as well as any defects including
structural defects and/or contamination, if any, which may
exist. The Clerk & Master/Special Commissioner has undertaken NO
inspections, examination or cleanup of the subject property.
