In obedience to Judgments/Orders of the Chancery Court at Greeneville, Tennessee, in the above-styled case, I will on Saturday, the 15th day of September, 2012, beginning at 10:01 a.m. ON THE PREMISES, SELL, without the right of redemption or equity of redemption and subject to the Judgments/Orders entered in the above captioned cause(s), to the best and highest bidder, the real property described in the corresponding papers, filed in the above referenced cause(s), and located in the 8th Civil District of Greene County, Tennessee. The address of the subject property [HOUSE & 5.81 acres + ] is as follows: 530 Warrensburg Road; Greeneville, TN 37743.
Pursuant to the orders of the Chancery Court for Greene County,
specifically the AGREED
ORDER OF SALE, entered June 11, 2012 in Minute Book 231,
pages 321- 323, as well as the
AMENDMENT TO AGREED
ORDER, entered August 15, 2012 in Minute Book 232, pages
__________, Kay Solomon Armstrong is ordered to sell, as Special
Commissioner/Master the real property, described as follows: SITUATE
in the 8th Civil District of Greene County,
Tennessee, and being more particularly described as follows: BEGINNING
at an iron pin at a 14 inch concrete monument which is situated
in the eastern margin of the right-of-way of Warrensburg Road
and corner to Lafollette (420-492); thence running with
Lafollette, South 88 deg. 09 min. 47 sec. East 567.18 feet to a
planted stone, corner to Ellenburg (410A-1970); thence running
with Ellenburg two (2) calls: South 10 deg. 45 min. 31 sec. East
254.74 feet to a post; thence South 11 deg. 52 min. 39 sec. East
388.64 feet to a point at post, situated in the northern margin
of the right-of-way of Warrensburg Road; thence running with the
northern margin of Warrensburg Road eight (8) calls: North 76
deg. 30 min. 45 sec. West 175.42 feet to an iron pin; thence
with a curve to the right having a deflection angle 18 deg. 36
min. 14 sec. with a length of 118.52 feet and a radius of 365.00
feet to an iron rod; thence with a curve to the right having a
deflection angle13 deg. 22 min. 23 sec. with a length of 85.19
feet and a radius of 365.00 feet to an iron rod; thence North 44
deg. 32 min. 08 sec. West 60.16 feet to an iron rod; thence
North 39 deg. 48 min. 12 sec. West 66.47 feet to an iron pin;
thence North 30 deg. 34 min. 37 sec. West 79.03 feet to an iron
rod; thence North 35 deg. 11 min. 05 sec. West 130.13 feet to an
iron rod; thence North 31 deg. 45 min. 05 sec. West 282.90 feet
to the point of BEGINNING, containing 5.81 acres, more or less,
according to a survey of Joseph G. McCoy, III, Tennessee
Registered Land Surveyor No. 1430, dated July 31, 2012. BEING the
same property conveyed to Charles Harold by deed of Hobert Hux,
et ux, dated November 19, 1929, and which is of record in Deed
Book 189, page 128, in the Register's Office for Greene County,
Tennessee. The said
Charles L. Harold died on May 26, 1965, leaving his wife
Margaret Harold surviving him.
Margaret Harold and her daughter, Ruth Harold, conveyed
the aforesaid property to her son Ben Harold, subject to a life
estate reserved by Margaret Harold, in a deed dated October 31,
1966, and which is of record in Deed Book 247, page 212, in the
Register's Office for Greene County, Tennessee.
Margaret Harold died on May 4, 1974.
The said Ben Harold died on September 29, 1996, and in
his Last Will and Testament which is of record in Will Book 40,
page 282, in the Office of the Clerk & Master for Greene County,
Tennessee, he devised all of his real property equally to his
three sons: William F. Harold, Stephen L. Harold and Benjamin
Charles Harold, subject to a life estate devised to his wife,
Virginia L. Harold, who died on February 2, 2008.
Stephen L. Harold died intestate on January 1, 2002, at
which time he was survived by his wife, the Plaintiff Linda
Bible, and his only child, the Defendant Whitney Harold Davis,
as his only heirs at law.
Auction conducted, pursuant to
ORDER(S) of the Court, by:
TERMS OF
Sale of real property will be
made 10% down day of sale with the remainder paid on or before
thirty (30) days from the date of sale. BID SHALL NOT BE LEFT
OPEN. ALL PROPERTY WILL BE SOLD "AS IS" WITH NO
WARRANTIES, AND WITH NO REPRESENTATION BEING MADE AS TO THE
STATE OF THE TITLE OR THE ACCURACY OF THE LEGAL DESCRIPTION OF
THE REAL PROPERTY.
(Said property will be sold subject to all rights-of-way and
easements, applicable building/zoning regulations, any
restrictive covenants, as well as any defects including
structural defects and/or contamination, if any, which may
exist. The Clerk &
Master/Special Commissioner has undertaken NO inspections,
examination or cleanup of the subject property.)
