LAND SALE NOTICE November 17, 2018 beginning at 10:01 a.m.
IN THE CHANCERY
COURT OF THE STATE OF TENNESSEE THIRD JUDICIAL DISTRICT, SITTING AT GREENEVILLE
RE: 39.24 acres, more or
less and according to recent surveying of Azimuth Engineering, Inc., of
the late Uriah Matthew (U.M.) Clemmer, Jr. and wife, the late Virginia
Rader Clemmer: Clemmer
Drive in Chuckey, TN 37641 [Map
77, Parcels 54 & 54.01] in the
15th Civil District of Greene County. A preliminary plat, dated 10/26/18 for an “auction flyer”, is incorporated herein and reflects specific tracts of subdivision. In obedience to Judgments/Orders of the Chancery Court at Greeneville, Tennessee, in the above-styled case, I will on Saturday, the 17th day of November, 2018, commencing at 10:01 a.m. ON THE PREMISES, SELL, without the right of redemption or equity of redemption and subject to the Judgments/Orders entered in the above captioned lawsuit, to the best and highest bidder, the real property described in the corresponding papers, filed in the above referenced partition suit and specifically and, at least, pursuant to ORDERS (entered 7/19/18 and 9/27/18). SITUATE in the 15th Civil District of Greene County, Tennessee, adjoining the lands of Charles Johnson, Chuckey Road and Nolichuckey River, and being described as follows:

BEGINNING at the middle of the Nolichuckey River, thence North 27 deg.
57 min. West, 79.5 feet to a cedar in a bluff, course continued 1,169
feet to a post; thence South 57 deg. 14 min. West, 391.8 feet; thence
South 57 deg. 44 min. West, 397.1 feet to a pipe; thence South 88 deg.
96 min. West, 396.7 feet to a large dead white oak; thence South 65 deg.
49 min. West, 400.9 feet to a post; thence South 63 deg. 13 min.
West, 177.3 feet to an iron pipe; thence South 39 deg. 4 min.
East, 226.4 feet to a stone; thence South 41 deg. 25 min. East, 295.5
feet to a stone; thence South 36 deg. 58 min. West, 210.2 feet to the
center of the Chuckey Road, thence with the center of said road to the
center of the Earnest Bridge; thence up the center of the Nolichuckey
River to the point of BEGINNING, containing approximately 50 acres.
BEING the same property conveyed to Uriah M Clemmer and wife, Virginia
R. Clemmer, by Deed Of Interest of Wilhelmina Williams and husband,
Beverly Lyle Williams, dated January 17, 1997, of record in Deed Book
62A, page 621, Register’s Office for Greene County, TN. See also Deed in
which a one-third (1/3) undivided interest was conveyed to Wilhelmina
Williams and husband, Beverly Lyle Williams, by deed of Willie C.
Massengill, dated October 30, 1996, of record in Deed Book No. 48A, page
782, said Register’s Office.

in the foregoing description but EXCLUDED from this conveyance are:
Lots Nos. 4, 5, 6, 9 and 10 of Riverside Estates, a plat of which
appears of record in Plat Book No. 10, page 39, Register’s Office for
Greene County, TN, to which reference is made for a more complete
description.
Map 77, Parcel 54.01 –
BEING all of Lot No. 9 of the Riverside Estates as reflected on a plat
which is of record in Plat Book 10, page 39, in the Register’s Office
for Greene County, TN, reference to which plat is incorporated herein
for a metes and bounds description thereof.
BEING the same property conveyed to Uriah M Clemmer and wife, Virginia
R. Clemmer, by Quitclaim Deed of Willie C. Massengill, dated July 29,
1987, of record in Deed Book 406, page 354 in the Register’s Office for
Greene County, TN. Also being a portion of the same property in which an
undivided one-third (1/3) interest was conveyed to John W. Massengill
and wife, Willie C. Massengill, by deed of Claudius G. Clemmer and wife,
Katherine E. Clemmer, dated January 1, 1960, and which is of record in
Deed Book 309, page 244, said Register’s Office.

The parties, in the subject partition suit, inherited the property from
their father, Uriah M. Clemmer, who died on May 3, 2003, his Will being
probated at Probate Case No. 2003P116 in the office of the Clerk &
Master of the Chancery Court (Probate Division) for Greene County,
Tennessee. The parties’
mother, Virginia Rader Clemmer, predeceased her husband on April 17,
2003. See Probate Case No. 2003P115 in said office.
Pursuant to the ORDER, entered 10/8/18, in the Greene County Chancery
Court {Docket #:
No. 2017-CV-227}, note the following RESTRICTIONS: "…restriction that no trailers, trailer parks, single wide trailers, or doublewide trailers will be built upon the properties."
