     In obedience to Judgments/Orders of the Chancery Court at Greeneville, Tennessee, in the above-styled cases, I will on Saturday, the 28TH day of AUGUST, 2010, beginning at 10:01 a.m. ON THE PREMISES, SELL, without the right of redemption or equity of redemption and subject to the Judgments/Orders entered in above captioned cause, to the best and highest bidder, the real property described in the corresponding filings, filed in the above referenced cause, and located in the 9th Civil District of Greene County, Tennessee [Map 122I, Group B, Parcel 24], at 105 Debusk Road; Greeneville, TN  37743.
[Pursuant to the “Order of Sale”, entered May 24, 2010, items of personal property of the Estate of Irene Josephine Brooks will also be sold at this time. Items of personalty are, at least, as follows: small antique table, antique wardrobe and handmade kitchen cupboard.]

SITUATE in the 9th Civil District of Greene County, Tennessee, being Lots Nos. 28, 29 and 30 of the “Lonnie Bird Sale”, as shown by plat and survey of J. C. Rowan, dated November 4th, 1938, of record in Plat Book No. 1, Page 204, in the Register’s Office of Greene County, Tennessee, and reference is made to said plat of record for a full and complete description of the lots herein conveyed. 

BEING the same property conveyed to Willis Brooks and wife, Irene Brooks, by deed of Russell Fancher and wife, Eula Fancher, dated April 16, 1949 of record in Deed Book 174, page 7, in the Register’s Office for Greene County, Tennessee.  The said Irene Brooks died testate (#2009P110) a citizen and resident of Greene County, Tennessee. The said Willis Brooks predeceased his wife, Irene Brooks, having died in December, 1985.

HOWEVER, THERE IS EXCEPTED from the above described property, a 0.24 acre tract of land conveyed to Howard Collins and wife, Marie Collins, by deed of Irene Brooks (widow), dated January 2, 1986 and found of record in Deed Book 394, page 744, in the Register’s Office for Greene County, Tennessee and being more particularly described as follows:
BEGINNING at a point in the Southerly right of way line of the Debusk Road, and corner to property of Shope; thence leaving said right of way, South 24 deg. 00 min. West 208.5 feet to a point, corner to Brooks; thence with the line of Brooks, North 22 deg. 03 min. West 139.6 feet to a point in the Southerly right of way line of the Debusk Road; thence with said right of way, North 66 deg. 00 min. East, 150.2 feet to the point of BEGINNING, containing 0.24 acres, more or less, according to survey of David S. Albert, December 4, 1985.
THERE IS ALSO CONVEYED HEREWITH an easement for purposes of ingress and egress to the above described property, over a triangular tract adjoining the northeastern corner of the 0.24 acre tract and extending along the Debusk Road for 21 feet and extending south along the line of the 0.24 acre tract for 30 feet.  Said easement shall revert to the grantors herein should the subject real estate cease to be used as a site for a store.

SUBJECT to the following restriction:  No alcoholic beverages may be sold for consumption on the premises.

TERMS OF SALE

Sale of real property will be made 10% down day of sale with the remainder paid on or before thirty (30) days from the date of sale. BID(S) SHALL NOT BE LEFT OPEN.  PROPERTY WILL BE SOLD “AS IS” WITH NO WARRANTIES, AND WITH NO REPRESENTATION BEING MADE AS TO THE STATE OF THE TITLE OR THE ACCURACY OF THE LEGAL DESCRIPTION OF THE REAL PROPERTY.  The Clerk & Master has undertaken NO inspection, examination, repair or clean up of the real property.  (The property will be sold subject to all defects, including a broken water line, as well as any structural defects and contamination, if any, which may exist.)

All personal property will be sold “as is” with no warranties.
