In obedience to Judgments/Orders of the Chancery Court at Greeneville, Tennessee, in the above-styled cause, I will on Saturday, the 22nd day of November, 2008, beginning at 10:01 a.m. ON THE PREMISES, SELL, without the right of redemption or equity of redemption and subject to the Judgments/Orders entered in the above captioned lawsuit, to the best and highest bidder, the  real property  described in the corresponding pleadings/orders and located in the 15th Civil District of Greene County, TN on Clear Springs and Price Roads: [Tax Map 57, Parcels 73, 73.02, 73.03]

 SITUATE in the 15th Civil District of Greene County, Tennessee and being more particularly described as follows:

 BOUNDED on the North by J.M. Million, on the South by Herman M. Smith, on the East by Manuel Miller, on the West by Hillary R. Ramsey, and described as follows:

 BEGINNING at a stake by the West side of the road and at the intersection of a graded road, said stake bearing North 26 deg. 20 mins. East 1.17 chs. From a set stone within 44-1/2 links of the North corner of Mt. Bethel Church; and running thence (meridian:  magnetic as of January 2, 1951) North 26 deg. 20 min. East 14.65 chs. To a large fence post on Million’s line; thence with his line, North 70 deg. West 12.93 chs. To a set stone; South 48 deg. West 12.13 chs. To a stake; and North 46 deg. 10 mins. West 19.15 (19.24 on slope) chs. To a set stone, a corner to Ramsey; thence with Ramsey’s line S. 24 deg. 05 mins. West 24.84 (24.90 on slope) chs. to a set stone; and S. 87 deg. 15 mins. E. 11.03 chs. To a stone in a stump hole, on a line of Smith; and thence with Smith’s line North 35 deg. 30 mins. East 0.41 chs. To a stake, bearing S. 52 deg. East 9 links from a small black oak near the North end of a gate; South 86 deg. 15 mins. East 13.25 chs. To a point on the North shoulder of an old road; and South 64 deg. 25 mins. East 7.87 chs. To a stake in center of old road, and bearing South 41 deg. East 25 links from a large corner post; thence a divisional line with a new road North 58 deg. 45 mins. East 8.19 chs. to the BEGINNING, containing 64.55 acres, more or less, according to survey made by Carl W. Rhe, surveyor, January 19, 1951.

THERE IS EXCEPTED HEREFROM a 7.5 acre tract conveyed to John Henry Price and wife, Frances L. Price which appears of record in Deed Book 281, page 19, in the Register’s Office for Greene County, Tennessee, to which further reference is hereby made.

THERE IS EXCEPTED HEREFROM a 7.0 acre tract conveyed to Barbara Jean Thomas which appears of record in Deed Book 307, page 479, in the Register’s Office for Greene County, Tennessee, to which further reference is hereby made.

THERE IS EXCEPTED HEREFROM a 5.0 acre tract conveyed to Mary Belle Bowers and Lois Price, as joint tenants with right of survivorship, which appears of record in Deed Book 380, page 531, in the Register’s Office for Greene County, Tennessee. For further reference see Deed Book 118A, page 816, in the Register’s Office for Greene County, Tennessee.

THERE IS EXCEPTED HEREFROM a 2.7412 acre tract conveyed to the Mt. Bethel Christian Church Trustees which appears of record in Deed Book 440, page 146, in the Register’s Office for Greene County, Tennessee, to which further reference is hereby made.

THERE IS EXCEPTED HEREFROM a 1.013 acre tract conveyed to Anthony Conley and wife, Sonja Conley which appears of record in Deed Book 449, page 769, in the Register’s Office for Greene County, Tennessee.  For further reference see Deed Book 445, page 81, in the Register’s Office for Greene County, Tennessee.

BEING a portion of the same property conveyed to John Henry Price, Jessie Price and Anna Lou Price by deed dated December 9, 1933, and appearing of record in Deed Book 129, page 525, in the Register’s Office for Greene County, Tennessee.  For deed from John Henry Price and Jessie Price to Anna Lou Price see deed Book 158, page 28, in the same said Register’s Office.  Anna Lou Price died testate on January 6, 1965 and pursuant to the terms of her Last Will and Testament, which appears of record in Will Book 10, page 52, in the County Court Clerk’s Office for Greene County, Tennessee she devised the subject property to Mary Belle Bowers and Lois Price, subject to a life estate devised to Jessie Price.  Jessie Price died July 22, 1967.  Lois Price died intestate in Greene County, Tennessee on December 28, 1991 to which further reference is made to Probate File No. 96P037 in the County Court Clerk’s Office for Greene County, Tennessee.

“Parties Interested”, pursuant to T.C.A. 35-5-104:  Dan Walker, Greene County Trustee; Mt. Bethel Christian Church; Anthony Conley et ux, Sonja Conley; Donna Groom.

Real Property description(s) is/are taken from the previous deed(s) of record.  Auction conducted by: Carter Real Estate & Auction Co. at 444 Bernard Ave.; Greeneville, TN (423) 639-7856.

TERMS OF SALE

Sale of real property will be made 10% down day of sale with the remainder paid on or before thirty (30) days from the date of sale. BID(S) SHALL NOT BE LEFT OPEN.  ALL PROPERTY WILL BE SOLD “AS IS” WITH NO WARRANTIES, AND WITH NO REPRESENTATION BEING MADE AS TO THE STATE OF THE TITLE OR THE ACCURACY OF THE LEGAL DESCRIPTION OF THE REAL PROPERTY.  The Clerk & Master has undertaken NO inspections, examination or clean up of the real property.  (The property will be sold subject to all defects, including any structural defects and contamination, if any, which may exist.)
